Privacy Policy

This Privacy Policy for personal data (the “Privacy Policy”) has been developed in accordance with Federal Law No. 152-FZ dated 27 July 2006 “On Personal Data” (the “Personal Data Law”) and is intended to define the procedure for processing personal data and the measures to ensure the security of personal data of individuals that LLC “Hamster”, TIN 6678108570, 27/1 Olkhovskaya St., Yekaterinburg, 620141 (the “Operator”) may obtain.

  1. Key Terms
    1. Personal data — any information relating directly or indirectly to a specific or identifiable personal data subject.
    2. Website — a set of graphic and informational materials, as well as computer programs and databases, ensuring their availability on the Internet at: https://3dkeeper.com and all subdomains created on its basis.
    3. Processing of personal data — any action (operation) or set of actions (operations) performed with personal data using automation tools or without using such tools, including:
      1. collection;
      2. recording;
      3. systematization;
      4. accumulation;
      5. storage;
      6. clarification (updating, modification);
      7. extraction;
      8. use;
      9. transfer (distribution, provision, access);
      10. depersonalization;
      11. blocking;
      12. deletion;
      13. destruction of personal data.
    4. Automated processing of personal data — processing of personal data using computer equipment.
    5. Distribution of personal data — actions aimed at disclosure of personal data to an indefinite number of persons.
    6. Provision of personal data — actions aimed at disclosure of personal data to a specific person or a specific group of persons.
    7. Blocking of personal data — temporary suspension of processing of personal data (except where processing is necessary to clarify personal data).
    8. Destruction of personal data — actions resulting in the impossibility of restoring the content of personal data in the personal data information system and/or resulting in destruction of physical media containing personal data.
    9. Depersonalization of personal data — actions resulting in the impossibility, without using additional information, to determine that personal data belongs to a specific personal data subject.
    10. Personal data information system — a set of personal data contained in databases and the information technologies and technical means ensuring their processing.
    11. Cross-border transfer of personal data — transfer of personal data to the territory of a foreign state to a foreign state authority, a foreign individual, or a foreign legal entity.
    12. Personal data operator (Operator) — an entity that independently or jointly with others organizes and/or carries out processing of personal data, and determines the purposes of personal data processing, the composition of personal data subject to processing, and actions (operations) performed with personal data.
    13. Personal data subject — an individual to whom the relevant personal data relates.
    14. User — an individual to whom the relevant personal data relates, who views the Website content and/or uses the Website functionality.
    15. Customer — any legally capable individual who has accepted the Operator’s offer. The content and terms of the offer are posted at https://3dkeeper.com and on all subdomains created on its basis.
    16. Subdomain — pages or a set of pages located on third-level domains belonging to the Website https://3dkeeper.com, as well as other temporary pages where the Operator’s contact details are indicated at the bottom.
    17. Cookies — a small piece of data sent by a web service and stored on the personal data subject’s computer, which the browser sends to the web server in an HTTP request each time it attempts to open a page of the relevant Website.
    18. Consent to distribution of personal data — actions performed by the Customer or User confirming permission granted to the Operator to distribute personal data.
    19. IP address — a unique network address of a node in a computer network through which the personal data subject accesses the Website.
  2. General Provisions
    1. Information about the Operator:
      1. The Operator is LLC “Hamster”, TIN 6678108570, 27/1 Olkhovskaya St., Yekaterinburg, 620141. The current version of the Privacy Policy is posted on the Operator’s Website at: https://3dkeeper.com (including subdomains). All categories of personal data subjects covered by the Privacy Policy must review the text of the Privacy Policy.
    2. Transfer by a personal data subject of personal information means the personal data subject’s unconditional consent to the terms of the Privacy Policy and the processing conditions stated therein. If the personal data subject disagrees with the Privacy Policy, they must refrain from transferring personal information to the Operator.
      1. The Privacy Policy (including any part of it) may be amended by the Operator without any special notice and without any compensation in connection with such amendment. The new version of the Privacy Policy enters into force from the moment it is posted on the Operator’s Website.
      2. By accepting the Privacy Policy, the personal data subject expresses their consent to the Operator’s processing of the subject’s data and consent to processing of personal data permitted by the personal data subject for distribution for the purposes provided in the Privacy Policy.
      3. Use of the Website and its services via a web browser that accepts Cookies means the personal data subject consents to the Operator collecting and processing Cookies data to improve the Website, its content, and functionality. Disabling and/or blocking Cookies in the web browser may limit use of the Website, including some of its functions.
      4. The Operator does not verify the accuracy of personal information provided by a personal data subject. Therefore, the Operator assumes that when personal data are provided, the User/Customer: · is legally capable. If a person using the Websites is legally incapable, consent to processing of personal data is provided by the legal representative of the User, who has reviewed and accepted the processing conditions specified in this Policy; · provides accurate information about themselves or about the legally incapable person represented (clause 4.1.1) to the extent necessary for using the Website. The User independently keeps their personal data up to date.
  3. Purpose of Processing and the Scope of User Information Collected and Processed by the Operator
    1. The Privacy Policy applies to the following types of personal information:
      1. Personal information posted by Users. Such personal information may include, in particular: full name, phone number, email address, link to the User’s social network page, city of residence, age. It is prohibited for the User to provide personal data of third parties without permission obtained from such third parties for such distribution, unless those third-party personal data were obtained by the User from publicly available sources.
      2. Data automatically transmitted to the Website during use via software installed on the User’s device, including IP address, unique device network identifier (MAC address, device ID), electronic serial number (IMEI, MEID), Cookies data, browser information, operating system, access time, and the User’s search queries.
    2. The Operator collects and processes only the information about Users (including their personal data) that relates to achieving the following purposes:
      1. registration and identification of the User on the Website;
      2. establishing and maintaining communication between the Customer and the Operator, consulting on the Operator’s services;
      3. sending to the User advertising messages and informational mailings about the Operator’s products and services and those of its partners, special offers, promotions, giveaways, contests, surveys — to the User’s email address, phone number (and/or user name) via WhatsApp, Viber, Telegram, by postal mail, SMS, push notifications, and also communicating such information by phone orally;
      4. audience analysis by territorial and age criteria;
      5. making a return call;
      6. administration and protection of the Website, including troubleshooting, data analysis, testing, system maintenance, support, reporting, and data hosting.
    3. If it becomes necessary to use Users’ personal information for purposes not provided in this Privacy Policy, the Operator will request the User’s consent for such actions.
  4. Purpose of Processing and the Scope of Customer Information Collected and Processed by the Operator
    1. The Privacy Policy applies to the following types of personal information:
      1. Personal information posted by Customers. Such personal information may include, in particular: full name, phone number, email address, link to the User’s social network page, city of residence, age. It is prohibited for the Customer to provide personal data of third parties without permission obtained from such third parties for such distribution, unless those third-party personal data were obtained by the Customer from publicly available sources.
      2. Data automatically transmitted to the Website during use via software installed on the Customer’s device, including IP address, unique device network identifier (MAC address, device ID), electronic serial number (IMEI, MEID), Cookies data, browser information, operating system, access time, and the Customer’s search queries.
      3. Data additionally provided by Customers at the Operator’s request for the purpose of fulfilling the Operator’s obligations to Customers regarding use of the Website.
    2. The Operator collects and processes only the information about Customers (including their personal data) that relates to achieving the following purposes:
      1. performance of obligations that have arisen or may arise for the Operator during performance of the Agreement concluded under the Offer, including for contacting the Customer by the Operator and/or its authorized representatives;
      2. registration and identification of the Customer on the Website;
      3. establishing and maintaining communication between the Customer and the Operator, consulting on the Operator’s services;
      4. concluding agreements and fulfilling the Operator’s obligations to the User under them;
      5. sending to the Customer advertising messages and informational mailings about the Operator’s products and services and those of its partners, special offers, promotions, giveaways, contests, surveys — to the Customer’s email address, phone number (and/or customer name) via WhatsApp, Viber, Telegram, by postal mail, SMS, push notifications, and also communicating such information by phone orally;
      6. administration and protection of the Website, including troubleshooting, data analysis, testing, system maintenance, support, reporting, and data hosting.
    3. If it becomes necessary to use Customers’ personal information for purposes not provided in this Privacy Policy, the Operator will request the Customer’s consent for such actions.
  5. Purposes of Processing and the Scope of Information About Counterparties (Individuals, Employees of Counterparties — Individual Entrepreneurs and Legal Entities)
    1. The Privacy Policy applies to the following types of personal information:
      1. Personal information provided by counterparties. Such personal information may include, in particular: last name, first name, patronymic, place of work, position, residence address (for a counterparty who is an individual entrepreneur or a person applying a special tax regime — professional income tax); contact details (phone number, email address). It is prohibited for the counterparty to provide personal data of third parties without permission obtained from such third parties for such distribution, unless those third-party personal data were obtained by the counterparty from publicly available sources.
      2. Other information about counterparties, the collection and/or processing of which is established by agreement.
    2. The Operator collects and processes only the information about employees (including their personal data) that relates to achieving the following purposes:
      1. concluding agreements and fulfilling obligations under agreements;
      2. fulfilling requests of state authorities.
  6. Purposes of Processing and the Scope of Information About Employees and Former Employees
    1. The Privacy Policy applies to the following types of personal information:
      1. Personal information provided by employees and former employees. Such personal information may include, in particular: last name, first name, patronymic, gender, marital status, family composition, citizenship, nationality, identity document details, military registration, employment and general work experience, previously held positions, taxpayer identification number, individual personal account insurance number; contact details (phone number, residential address, email address).
    2. The Operator collects and processes only the information about employees and former employees (including their personal data) that relates to achieving the following purposes:
    3. compliance with labor law requirements;
    4. carrying out employment relations;
    5. carrying out banking operations;
    6. organizing access control.
  7. Legal Grounds for Processing Personal Data
    1. The Privacy Policy is developed in accordance with clause 2 part 1 article 18.1 of the Personal Data Law.
    2. The Privacy Policy contains information subject to disclosure in accordance with part 1 article 14 of the Personal Data Law and is a publicly available document.
    3. Legal grounds for processing personal data include: :- agreements concluded between the Operator and the personal data subject.
    4. The Operator processes personal information (including personal data) only if:
      1. processing is necessary for the Operator to fulfill contractual obligations to personal data subjects;
      2. processing is necessary to comply with obligations established by law;
      3. where provided by applicable law, processing is necessary to ensure the Operator’s legitimate interests, provided such processing does not materially affect the interests, fundamental rights, and freedoms of the personal data subject. When processing personal information on this basis, the Operator will always seek to maintain a balance between its legitimate interests and protection of the personal data subject’s confidentiality.
  8. Processing of Personal Data of Personal Data Subjects
    1. In most cases, personal data are processed automatically without the Operator having access to them. If such access is required, it may be granted only to those persons who need it to perform their tasks. To protect and ensure confidentiality, all persons must comply with internal rules and procedures regarding personal data processing and follow all technical and organizational security measures in effect for protecting personal data.
    2. Personal data of Russian personal data subjects are stored in the Russian Federation. The Operator records, systematizes, accumulates, stores, clarifies (updates, modifies), extracts personal data of citizens of the Russian Federation using databases located in the territory of the Russian Federation.
    3. The Operator has implemented sufficient technical and organizational measures to protect personal data from unauthorized, accidental, or unlawful destruction, loss, alteration, bad-faith use, disclosure, or access, and other unlawful forms of processing, taking into account the current state of technology, the cost of implementation, the risks associated with processing, and the nature of personal data. Such measures include, in particular: antivirus protection with regularly updated databases; backup of information; restriction of the circle of persons having access to personal data.
    4. The Operator will store personal data for as long as necessary to achieve the purpose for which they were collected, or to comply with legal and regulatory requirements.
    5. The Operator transfers personal data of Users and Customers to third parties if the personal data subject has given consent to such actions or if such transfer is provided by the laws of the Russian Federation.
    6. The personal data subject is hereby informed and agrees that the Operator may receive personal data of third parties provided by the personal data subject when using the Website and social networks, and use them to implement certain functions of the Website, provided the personal data subject guarantees that they have the consent of such third parties to processing by the Operator for the purposes provided in this Privacy Policy, as well as to transfer of such data in the cases listed in this Privacy Policy.
    7. The personal data subject is hereby informed and agrees that the Operator may obtain statistical depersonalized (not linked to the personal data subject) data about the personal data subject’s actions when using the Website. The personal data subject has the right, upon request, to receive from the Operator information regarding the processing of their personal data.
  9. Withdrawal of Consent, Updating and Correction of Personal Data, Responses to Access Requests
    1. The personal data subject has the right at any time to withdraw the consents and permissions provided for processing of personal data and consent to processing of personal data permitted by the personal data subject for distribution, as well as to refuse notifications and mailings, by sending a message to: support@3dkeeper.com.
    2. The personal data subject has the right to request deletion, correction, updating of personal data, restriction of processing, or to object to processing of personal data when provided by applicable law. The Operator responds to such requests in accordance with applicable law.
    3. If the inaccuracy of personal data or unlawfulness of processing is confirmed, personal data must be updated by the Operator and processing must be terminated.
    4. The Operator must, upon request, provide the personal data subject or their representative with information about the processing of their personal data.
    5. Upon achievement of the purposes of processing personal data, as well as in the event the User withdraws consent to processing, personal data are subject to destruction, unless: - otherwise provided by the agreement to which the personal data subject is a party, beneficiary, or guarantor; - the Operator is entitled to process data without consent on the grounds provided by the Personal Data Law or other federal laws; - otherwise provided by another agreement between the Operator and the personal data subject.
  10. Response Procedure for Requests/Appeals of Personal Data Subjects, Their Representatives, and Authorized Bodies
    1. A personal data subject may submit a request in written or electronic form.
    2. Written requests include any written appeals sent to the Operator, including appeals sent through postal services.
    3. Electronic requests include appeals sent by email. In this case, the request must be signed with an electronic signature of the personal data subject in accordance with the laws of the Russian Federation. The Operator does not process requests related to transfer or disclosure of personal data received by phone or fax due to the inability to identify the personal data subject.
    4. Procedure for reviewing requests and appeals: A written response is sent by the Operator regardless of the form of the request (written or electronic) and the results of review. Responses are prepared by the Operator. Requests and appeals are checked for the presence of: - last name, first name, and patronymic of the applicant; - last name, first name, and patronymic of the personal data subject; - number of the main identity document of the personal data subject or their legal representative, date of issue, and issuing authority; - handwritten signature of the personal data subject (for written requests and appeals); - electronic signature (for electronic requests).
    5. If necessary, the Operator requests additional information from the personal data subject. The response time does not exceed 30 (thirty) business days from receipt of the appeal. The information provided to the personal data subject in an accessible form does not contain personal data relating to other personal data subjects.
  11. Legal Grounds for Processing and Distribution of Personal Data

    Civil Code of the Russian Federation; Federal Law No. 152-FZ dated 27 July 2006 “On Personal Data”; Federal Law No. 149-FZ dated 27 July 2006 “On Information, Information Technologies and Protection of Information”; Decree of the Government of the Russian Federation No. 1119 dated 1 November 2012 “On Approval of Requirements for Personal Data Protection in Personal Data Information Systems”; Decree of the Government of the Russian Federation No. 687 dated 15 September 2008 “On Approval of the Regulation on the Specifics of Processing Personal Data Carried Out Without Automation Tools”; User consent to processing of personal data; consent to processing of personal data permitted by the personal data subject for distribution.

  12. Final Provisions
    1. The Privacy Policy, relations between the personal data subject and the Operator arising in connection with application of the Privacy Policy, as well as issues not regulated by the Privacy Policy, are governed by the laws of the Russian Federation.
    2. The Operator reserves the right to amend the Policy. The User must review the Policy text each time they use the Website again.
    3. The new version of the Policy enters into force from the moment it is posted in the relevant section of the Websitehttps://3dkeeper.com and on all subdomains created on its basis. Continued use of the Website or its services after publication of the new version means the User accepts the Policy and its terms.
    4. If the User disagrees with the Policy terms, they must immediately stop using the Website https://3dkeeper.com and all subdomains created on its basis, as well as the services of the Website.
